Letter to Premier Carpenter

Dear Mr Carpenter,

I write to appeal to you as Premier of Western Australia to instruct the State Solicitor to reinstate the Supreme Court appeal of the verdict in the recent live export cruelty case.

The WA State Solicitor's advice is that the Magistrate erred in her judgement and should have convicted live export company Emanuel Exports Pty Ltd and its two directors of animal cruelty. Despite this advice, Minister Ljiljanna Ravlich ordered the appeal against the verdict to be withdrawn.

The unavoidable conclusion from Minister Ravlich's intervention is that your government is not willing to bring live exporters to justice—regardless of whether or not they have breached the WA Animal Welfare Act. The Minister's suggestion that she would prefer to resolve this case through discussion between State and Federal governments completely ignores the fact that the defendants were on trial for serious breaches of WA legislation that resulted in the suffering and deaths of thousands of animals.

When the WA Animal Welfare Act was passed your government proudly claimed that this Act would protect all animals, regardless of their use. Premier Carpenter, if this statement is true then you must act to reinstate this appeal. To not do so would deny justice to the thousands of animals who were the victims in this matter—and send the dreadful message to the live export industry that they are above the law.
